ShareRoo Terms and Conditions (T&C’s)

introduction

Welcome to ShareRoo, an online platform designed for individuals and businesses to share items through rental agreements. By using ShareRoo, you confirm that you have read, understood, and agreed to these Terms and Conditions. These terms apply to all users, including item Owners and Renters.

ShareRoo's T&C’s form a legally binding agreement for users of its platform. The contract begins upon registration confirmation and is valid during service use. Users must meet eligibility criteria (Australian resident aged 16+).

ShareRoo may amend these T&C’s at any time, and continued use of the platform constitutes acceptance of any changes.

Users can terminate their accounts if they disagree with the T&C’s and updates. Non-registered users who do not agree to the T&C’s may not use the platform.

Account Registration, Termination, and Suspension

ShareRoo's platform enables registered users to rent or lend movable items as Owners or Renters. Users negotiate rental agreements directly and ShareRoo acts solely as an intermediary and is not a party to these agreements.

Identity verification is built into the platform, but it is also the Owners responsibility to verify the Renters identity before sharing the item. The rental process requires a valid payment method and is open to individuals or authorized representatives of legal entities. ShareRoo may advertise certain Owners or items with consent but has no obligation to promote. Each user acts independently, with no partnership or joint venture implied.

Registration Requirements:

  • Users must provide valid personal information, including name, address, gender and age.
  • Users must be at least 16 years old to register.

Termination and Suspension:

  • ShareRoo reserves the right to suspend or terminate accounts for policy breaches, unresolved disputes, or misuse.
  • Users may terminate their accounts at any time, but outstanding obligations (e.g., rental fees, disputes) must be resolved prior to termination.

Owner Agreement

By listing your items on the ShareRoo platform, you agree to the following terms to ensure a safe and reliable rental experience:

  1. Ownership & Responsibility: You confirm that you own or have the authority to list items for rent. You are responsible for providing accurate descriptions, fair pricing, and clear usage instructions.
  2. Condition & Maintenance: Items must be in good working order and suitable for rental. You are responsible for regular maintenance and ensuring items meet safety standards.
  3. Insurance & Liability: ShareRoo offers limited coverage under the Owner's Guarantee. However, it is your responsibility to understand any additional insurance needs. Claims under the guarantee require proper documentation.
  4. Payments & Disputes: ShareRoo will process payments on your behalf. In case of damage, loss, or theft, claims will be resolved according to our Owner's Guarantee Policy.
  5. Code of Conduct: As an Owner, you must treat Renters respectfully, respond promptly to inquiries, and honour confirmed bookings.

rental agreement

The rental agreement between Owner and Renter is solely governed by the individuals involved, with ShareRoo not assuming liability for any breach or failure to fulfil contractual obligations.

Owners must accurately describe rental items and have full rights to rent them. Rental agreements are confirmed when the Owner accepts the Renter's request, and cancellations must adhere to specified terms.

Renters are responsible for ensuring rented items are used properly and returned in the same condition, with potential fees for late returns or damages. Disputes regarding the rental item or its condition must be addressed promptly.

ShareRoo does not manage deposits or taxes, and both parties must ensure compliance with applicable laws. The platform provides a rating system for users, though it is not responsible for the accuracy of these ratings.

Return Process:

  • Items must be returned at the agreed time and location, in the same condition.
  • Owners must inspect returned items promptly to confirm their condition.

Refunds:

  • Refunds are not issued for accepted rentals unless items are unavailable or disputes are resolved in favour of the Renter.

Late Returns:

  • All costs associated with a late return will be charged to the Renter at the daily rental rate, and reimbursed to the Owner less the service and insurance fees.

Users of ShareRoo's eCommerce platform can publish content, including product listings, reviews, and comments, to enhance their experience and interact with others. By submitting content, users agree to the following:

  1. Ownership and Rights: Users retain ownership of their published content but grant ShareRoo a non-exclusive, worldwide, royalty-free license to use, display, and distribute it in connection with the platform.
  2. Content Standards: All submissions must be lawful, non-offensive, and free from misinformation, plagiarism, or copyrighted material without proper permissions.
  3. Responsibilities: Users are solely responsible for the accuracy, relevance, and compliance of their content with applicable laws and ShareRoo's guidelines.
  4. Moderation: ShareRoo reserves the right to review, edit, or remove content that violates policies or harms the platform's integrity. Persistent violations may result in account suspension.
  5. Marketing: ShareRoo may use published content for marketing or operational purposes.

By adhering to these guidelines, users contribute to a safe, trustworthy, and collaborative platform.

pricing and payment

The ShareRoo platform payment process involves Renters paying a total amount, including rent, service and insurance fees, which ShareRoo holds on behalf of the Owner. ShareRoo deducts service and insurance fees before transferring the remaining amount to the Owner within 10 days of the item's return, barring disputes. ShareRoo manages receivables, cooperates with third-party processors, and prohibits fee circumvention. Disputes may delay payments until resolved. Users must ensure valid payment methods and cover any late payment costs. ShareRoo limits liability for improper rent transfers.

Rental Fees:

  • Owners set the desired daily, weekly and monthly rental fees.

Payments:

  • Renters are charged upon acceptance of their rental request.
  • Payments are processed securely via the Stripe payment gateway.

Cancellation Fees:

  • Renters may cancel requests before approval without penalty.
  • After approval, cancellation fees may apply.

dispute resolution

In case of disputes between Owner and Renter, both parties should attempt to settle matters amicably. ShareRoo can facilitate communication and may access the details to assist, but is not obliged to mediate.

If ShareRoo is involved in legal proceedings, both parties are jointly liable for the costs. Rental items with a fee and insurance are covered under the insurance policy, as detailed on the insurance page.

Users must adhere to ShareRoo's privacy policy regarding personal data during dispute resolution.

Item Damage:

  • Renters are responsible for repairing or replacing damaged items.
  • If disputes cannot be resolved directly, an insurance claim may be filed.

Late Return:

  • All costs associated with a late return will be charged to the Renter at the daily rental rate, and reimbursed to the Owner less the service and insurance fees.

Stolen Items:

  • Owners must file a police report. ShareRoo will assist with insurance claims but is not liable for theft.

Mediation:

  • ShareRoo may mediate disputes but does not assume liability for resolution outcomes.

limitation of liability

ShareRoo limits its liability for any direct damages related to rental agreements and use of the platform.

Users of the ShareRoo online platform are granted a limited, non-exclusive, revocable right to access and use it per the T&Cs. ShareRoo strives for platform availability but does not guarantee continuous uptime. It may modify, limit, or suspend the platform (e.g., for maintenance) at its discretion without liability for interruptions or data loss. Users are responsible for backing up their data and cannot claim damages or lost profits from disruptions. The platform's underlying software is not licensed or copied for users.

Any claims for rental item defects or delays must be addressed directly between the Owner and Renter. ShareRoo is not responsible for indirect or consequential damages, including lost profits or data. Users are fully responsible for selecting their rental partners, entering contracts, and fulfilling rental obligations. ShareRoo is not liable for issues arising from the user’s inability to use the platform.

ShareRoo is not liable for:

  • Injuries or damages resulting from item use.
  • Losses due to system downtime or technical failures.
  • Misrepresentation of items by Owners.
  • Indirect, incidental, or consequential damages.

prohibited use and activities

Users of ShareRoo must adhere to the following restrictions:

  • Legal Compliance: Users must not engage in activities that violate local, state, or federal laws.
  • Item Misrepresentation: Owners must provide accurate descriptions and photos of items.
  • System Abuse: No use of bots, scripts, or software to manipulate the platform.
  • Prohibited Conduct: Aggressive, fraudulent, or harmful behaviour, including harassment or theft, is strictly forbidden.
  • Restricted Items: Items prohibited by law, hazardous materials, or illegal substances cannot be listed. See the Posting Policy for more details.

Violations may result in account suspension, termination, or legal action.

Users must comply with ShareRoo's intellectual property rights and not reproduce, modify, or exploit the platform's content without permission. They are responsible for understanding and adhering to applicable laws, including those related to rental objects. Users cannot engage in unlawful activities or violate third-party rights. ShareRoo may suspend accounts for violations. Users must ensure personal data is processed legally, keep their account information accurate, and protect login details. Any changes to user data must be reported promptly via the platform.

All users must:

  • Behave legally, respectfully, and responsibly.
  • Use rented items as intended and return them on time.
  • Cooperate in dispute resolution processes.

Failure to meet obligations may result in suspension, termination, or legal action.

intellectual property rights

All content on the ShareRoo platform, including logos, branding, and platform features, is protected by copyright and trademark laws. Users may not reproduce, distribute, or modify ShareRoo materials without written consent.

Privacy Agreement and User Data

ShareRoo collects and uses user data in accordance with our Privacy Policy. Personal data is stored securely and used only for service purposes. ShareRoo does not sell user data to third parties.

Product or Promotional Information

ShareRoo does not guarantee the accuracy of user-provided item descriptions.
